Terms and Conditions
The terms that apply when you use our website and services.
These Terms and Conditions govern your use of the website gutgrubltd.site and any engagement with Gut Grub Ltd. By using this website, you agree to these terms.
1. About us
This website is operated by Gut Grub Ltd, registered in England & Wales, with its address at 71-75 Shelton Street, Covent Garden, London, England, WC2H 9JQ, United Kingdom. Contact [email protected] or +48 794 439 086.
2. Use of the website
You agree to use this website lawfully and not to misuse it. All content is owned by or licensed to us and may not be reproduced without permission.
3. Information provided
Information on this website is provided for general guidance and does not constitute a binding offer or professional advice. Any proposal or quotation is subject to a written agreement.
3a. Nutrition, health and medicinal claims
No nutrition claim, health claim, medicinal claim or other claim about the effect of any product on the human body is made on this website or by us. In Great Britain a nutrition or health claim may be made about a food only if it is authorised and entered on the GB Nutrition and Health Claims Register, is expressed in the authorised wording or in wording having the same meaning for the consumer, and the conditions of use for that claim are met. It is separately prohibited to attribute to any food the property of preventing, treating or curing a human disease, or to refer to any such property: a product presented in that way is a medicinal product by presentation under the Human Medicines Regulations 2012 and may not be placed on the market without a marketing authorisation. Certain terms are themselves unauthorised health claims, “probiotic” among them. Nothing we supply is intended to prevent, treat, cure or alleviate any disease, condition or symptom, and nothing on this website should be read as suggesting that it does. Where a customer or brand owner asks for a claim to appear on packaging, we check it against the register before printing and decline it where it is not authorised; the brand owner named on the pack remains legally responsible for the information on it. Our trading name is a name and is not a claim about digestion, gut flora or any bodily function. Nothing on this website is nutritional, dietary or medical advice. Anyone with a health concern, a diagnosed condition, an allergy or an intolerance, and anyone who is pregnant or taking medication, should speak to a qualified healthcare professional rather than relying on anything here.
3b. Wholesale of pharmaceutical goods
SIC code 46460 appears on this company’s record and we explain it rather than leave it unexplained. Wholesale dealing in medicinal products in the United Kingdom — obtaining, holding, supplying, selling or exporting them — requires a Wholesale Dealer’s Licence granted by the Medicines and Healthcare products Regulatory Agency, and requires compliance with Good Distribution Practice and the appointment of a Responsible Person. Carrying on that activity without a licence is a criminal offence. This website does not state or imply that we hold a Wholesale Dealer’s Licence and you must not assume that we do. We do not obtain, hold, store, supply, sell or export medicinal products, and nothing offered through this website is a medicinal product. We claim no MHRA licence, registration or approval of any kind.
3c. Food safety, allergens and composition
Food business operators must be registered with the local authority, and premises handling products of animal origin and certain other products require approval rather than registration. Operators must put in place and maintain permanent procedures based on HACCP principles, and must provide allergen information for the fourteen allergens regulated under assimilated Regulation (EU) 1169/2011, emphasised in the ingredient list on pre-packed food. Food supplements are subject to their own composition and labelling rules, including the permitted lists of vitamin and mineral sources, and a food or ingredient with no significant history of consumption in Great Britain before May 1997 is a novel food requiring authorisation before it is placed on the market. These are obligations of the operator. This website does not state which registrations, approvals, procedures or audits are currently in place, claims no Food Hygiene Rating Scheme score, and claims no certification, audit standard, organic certification or accreditation. Where a specification, ingredient declaration or allergen statement is supplied to a trade customer, it relates to the product and batch stated and must be checked against each delivery; a trade customer reselling or using our products remains responsible for the allergen and composition information it gives to its own customers. Where a customer supplies a recipe, ingredients or artwork, that customer is responsible for their legality, safety and accuracy. Cross-contact between ingredients handled in the same facility cannot be excluded, and anyone with a serious allergy should ask before buying or consuming anything.
3d. Online sales, cancellation and delivery
Where we sell to a consumer at a distance, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply. You have the right to cancel within 14 days of the day you, or someone you name, receives the goods, without giving a reason; you then have a further 14 days to return them and we refund within 14 days of receiving the goods back or of proof of return, including standard outbound delivery. Two exceptions commonly apply to food: goods liable to deteriorate or expire rapidly, and sealed goods not suitable for return for health protection or hygiene reasons once unsealed. Where an exception applies it is stated before you order, not afterwards. None of this affects your rights under the Consumer Rights Act 2015 if goods are faulty, not as described or unfit for purpose. Prices, availability and delivery estimates are subject to confirmation and stock, estimates are not guarantees, and we are not liable for delays caused by carriers. Trade and wholesale supply is on separate written business terms, and business customers do not have the consumer cancellation right described above. Nothing on this website is an offer capable of acceptance.
4. Liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud. Subject to that, our liability in connection with this website is limited to the fullest extent permitted by law.
5. Privacy
We process personal data in accordance with our Privacy Policy.
6. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
7. Changes
We may update these Terms from time to time. The version published at the time of your visit applies.
